Terms of Service
Terms for public IDX use, protected PropTx/TRREB VOW access, communications, and Ontario real estate services.
1. Operator and brokerage identity
YorkNine is a real estate website and app operated by Quan Ve and Avi Samaroo, Sales Representatives, with CENTURY 21 Atria Realty Inc., Brokerage (Vaughan office), Ontario. YorkNine is not a separate brokerage. The brokerage identity and the applicable listing brokerage are displayed separately so a listing is not misattributed. By using YorkNine, you agree to these Terms and the Privacy Policy.
2. Real estate relationship and RECO information
Browsing public listings or sending a general inquiry does not by itself create representation. Any representation, designated representation, customer relationship, services, or financial obligation requires the separate disclosures, explanations, and agreements required by the Trust in Real Estate Services Act, 2002 (TRESA), its regulations, and the Real Estate Council of Ontario (RECO). Before regulated services or assistance are provided, the applicable RECO Information Guide and relationship disclosures must be provided and explained. YorkNine is not intended to solicit a buyer or seller already under contract with another real estate brokerage.
3. Accounts and VOW eligibility
Public active IDX listings may be viewed without VOW access. Protected sold, off-market, or other restricted listing information is available only through the YorkNine Virtual Office Website (VOW) after: (a) you sign in with unique account credentials; (b) you provide your legal name and the valid email associated with that account; (c) you accept the current VOW terms; (d) a lawful broker-consumer relationship exists for VOW property-information services; and (e) you confirm the email link sent to that signed-in account. One email may be associated with only one VOW username/password. VOW authorization expires no later than 90 days after confirmation and must then be renewed. YorkNine may suspend or revoke access where required by law, MLS® rules, security, or these Terms.
4. Required VOW use restrictions
VOW listing information is licensed only for your bona fide, personal, non-commercial interest in the purchase, sale, or lease of real estate of the type offered through the VOW. You must not copy, redistribute, retransmit, display, post, disseminate, distribute, publish, broadcast, transfer, sell, sublicense, scrape, data-mine, or create a database from VOW listing information. You must not provide VOW listing information to an artificial-intelligence system or other technology for collection, storage, reorganization, analysis, summarization, or manipulation. You must not remove brokerage attribution, MLS® notices, source notices, or copyright notices. No more than 100 identifiable VOW listings will be returned for one consumer inquiry.
5. Association rights, monitoring, and audit
The applicable Association/MLS® system owns or controls proprietary and copyright interests in its listing database. You authorize PropTx, TRREB, participating members, YorkNine, CENTURY 21 Atria Realty Inc., Brokerage, and their authorized representatives to access the VOW and review identity, agreement, search, view, and activity records to verify compliance with these Terms, MLS® rules, and law. Security and audit records may be retained for at least 180 days after VOW access or credentials expire, and longer where reasonably required. The VOW click agreement itself does not create representation or a financial obligation.
6. Listing display, source, and brokerage attribution
Listing information is supplied by PropTx/TRREB, participating brokerages, builders, public sources, or other authorized providers. YorkNine respects Internet-display and address-display instructions, refreshes VOW information at least as often as required, and does not knowingly display seller names or contact information, confidential brokerage-only remarks, showing/security instructions, or other fields prohibited from Internet display. The listing brokerage is shown with each property record and required source and copyright notices must remain visible.
7. Sold information, advertising, and sharing
Protected sold records are displayed only inside the authenticated VOW after authorization; they are not made available to public visitors through blurred cards, page source, autocomplete, maps, social previews, collections, or share links. Public property sharing is limited to eligible active IDX listings with Internet display permitted. Separate consent requirements may apply to any advertisement of a completed transaction, property, party, or sale price.
8. Automated and voice-assisted features
YorkNine automated assistants may process questions, preferences, and public active IDX information to help navigate the app. Protected PropTx/TRREB VOW records, sold prices, property histories, and sold-comparable evidence are excluded from external AI context and tool outputs. Any protected home-history or value journey opens separately in the secured app. Automated output may be incomplete or wrong and must not be treated as an appraisal or professional advice.
9. Accuracy and professional advice
Listing status, price, taxes, measurements, square footage, parking, property history, photographs, estimates, calculations, and availability may change or contain errors. Listing information is deemed reliable but is not guaranteed accurate. YorkNine content is not legal, tax, mortgage, appraisal, inspection, engineering, or investment advice. Verify material facts with the listing brokerage and appropriate qualified professionals before acting.
10. Requests, service messages, and CASL
A showing, valuation, alert, appointment, or contact request is not confirmed until accepted by the appropriate person. Transactional emails needed to confirm VOW access or complete a requested service are separate from marketing consent. Commercial electronic messages are sent only with consent or another lawful basis under Canada’s Anti-Spam Legislation (CASL), identify the sender, and include a working unsubscribe method where required. Marketing consent is not a condition of VOW access.
11. Acceptable use and security
Do not submit false information, impersonate another person, share credentials, interfere with the service, circumvent access controls, probe security, automate collection, overload the app, discriminate unlawfully, infringe rights, or use YorkNine for an unlawful purpose. Report a suspected access or data issue promptly. Access may be limited to protect consumers, MLS® data, the brokerage, and legal or regulatory compliance.
12. Availability and liability
YorkNine is provided “as is” and “as available.” We do not guarantee uninterrupted operation, complete inventory, alerts, appointments, estimates, or transaction outcomes. To the extent permitted by law, YorkNine, Quan Ve, Avi Samaroo, and CENTURY 21 Atria Realty Inc., Brokerage are not responsible for indirect or consequential loss arising from use of or reliance on the service. Nothing excludes liability or consumer rights that cannot lawfully be excluded.
13. Mobile app licence
Where you install YorkNine from the Apple App Store or Google Play, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, in accordance with these Terms and the applicable store rules. You may not copy, modify, reverse-engineer, or redistribute the app. The app is free to download and use; it contains no in-app purchases, subscriptions, or paid digital content. Real estate services are provided by the licensed individuals and brokerage named in Section 1 under separate agreements, not through the app store.
14. Apple App Store additional terms
For the iOS version of YorkNine, the following applies in addition to these Terms: (a) these Terms are between you and YorkNine/CENTURY 21 Atria Realty Inc., Brokerage only, not Apple, and Apple is not responsible for the app or its content; (b) the licence is limited to use on Apple-branded products you own or control as permitted by the App Store Terms of Service usage rules; (c) Apple has no obligation to provide maintenance or support; (d) in the event of any failure to conform to an applicable warranty you may notify Apple and Apple will refund any purchase price (there is none), and to the maximum extent permitted by law Apple has no other warranty obligation; (e) Apple is not responsible for addressing any product-liability, legal or regulatory claim, or consumer-protection claim relating to the app; (f) if a third party claims the app infringes its intellectual-property rights, YorkNine, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim; (g) you represent that you are not located in a country subject to a U.S. Government embargo or designated a “terrorist supporting” country and are not on any U.S. Government prohibited or restricted-parties list; (h) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you; (i) you must comply with applicable third-party terms (for example your wireless carrier’s data agreement) when using the app. Where the Apple Media Services Terms and Conditions or Apple’s Licensed Application End User Licence Agreement provide you greater rights, those terms prevail for the iOS app.
15. Google Play additional terms
For the Android version, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app, its content, or any support. YorkNine collects only the data described in the Google Play Data Safety listing and the Privacy Policy.
16. Device permissions, notifications, and location
The app requests location, microphone, notification, camera or photo permission only when you use the related feature, and you may decline or later revoke any permission in your device settings without losing access to search, listings, or your account. Device location is used only to position the map and is not stored. Push notifications are sent only after you enable them and can be turned off at any time. Standard carrier data rates apply.
17. Account deletion and termination
You may delete your account at any time in the app under My account → Security, or through the public Delete Account page. Deletion removes your profile and associated data as described in the Privacy Policy. We may suspend or terminate access for breach of these Terms, MLS® rules, or law. Sections that by their nature should survive (VOW restrictions, audit rights, liability, governing law) continue after termination.
18. Governing law, contact, and updates
These Terms are governed by Ontario law and applicable federal Canadian law.
